This notice fulfills the requirement for public disclosure of a real or perceived conflict of interest in
accordance with 24 CFR 84.42 and 570.611 for programs funded through the Community Development
Block Grant (“CDBG”).

CDBG Grant Amount: Approximately $18,000

Conflict of Interest Disclosure
The City of Scottsdale is a recipient of federal funds from the U.S. Department of Housing and Urban
Development (“HUD”) under the CDBG program. The City uses the CDBG grant to fund its Emergency
Repair / Replacement, and Roof Repair and Replacement Program (“Programs”).

The City of Scottsdale’s Housing & Community Assistance Office received an application for assistance
through the Programs from a member that sits on an advisory commission for the City of Scottsdale
(“Applicant”). The Applicant as a sitting advisory member may be in a position to participate in decisions
involving the use of federal CDBG funds which would pose a conflict of interest under federal regulations.

The applicable federal regulations at 24 CFR Section 570.611 states “(b) Conflicts prohibited. The general rule is that no persons described in paragraph (c) of this section who exercise or have exercised any functions or responsibilities with respect to CDBG activities assisted under this part, or who are in a position to participate in a decision making process or gain inside information with regard to such activities, may obtain a financial interest or benefit from a CDBG-assisted activity, or have a financial interest in any contract, subcontract, or agreement with respect to a CDBG-assisted activity, or with respect to the proceeds of the CDBG-assisted activity, either for themselves or those with whom they have business or immediate family ties, during their tenure or for one year thereafter. . . (c) Persons covered. The conflict-of-interest provisions of paragraph (b) of this section apply to any person who is an employee, agent, consultant, officer, or elected official or appointed official of the recipient, or of any designated public agencies, or of subrecipients that are receiving funds under this part.”

Exception
Federal regulations allow HUD to grant exceptions on a case-by-case basis, provided the City publicly discloses the nature of the potential conflict and the City Attorney issues an opinion that the interest for which the exception is sought would not violate State or local law. The City Attorney’s Office will review all documentation and issue a legal opinion regarding the Applicant’s potential conflict of interest.

Action Taken & HUD Exemption Request
To address this conflict, the Applicant has formally abstained from all voting, discussions, and decision-
making related to CDBG-funded projects, including the Programs noted above.

The Housing & Community Assistance Office will submit a request to HUD seeking an exception to the conflict-of-interest provision. HUD will evaluate the request based on various factors, including whether:

• undue hardship would result without the exception,
• the public interest is best served by granting it, and
• the individual did not receive an unfair advantage.

Individuals or organizations wishing to comment on this proposed exception may submit written
comments to Chad Beougher, Community Development Supervisor, at cbeougher@scottsdaleaz.gov on
or before August 1, 2026. All comments received by that date will be reviewed prior to submitting the final
exception request to HUD.
