Noise Ordinance (Adopted Sept. 28, 2010)

City Council adopted this ordinance on Sept. 28, 2010.  It goes into effect 30 days after adoption.

Ordinance highlights:

  • Only applies to businesses that serve alcohol and/or provide live entertainment
  • City staff pro-actively enforces, as well as investigates citizen complaints
  • Reasonable person standard used at 100’ from source, with maximum decibel threshold--68dB(A)--to assist in determining unreasonable noise level
  • Unamplified voice and crowd noise exempted
  • Discretion to issue Notice of Violation (NOV) as first course of action
  • Decriminalized—civil offense for first four violations
  • Criminal habitual violator provision after four or more civil violations within 24 month period
  • Larger fines in general
  • $2500 fine for violation of city approved Special Events Permit
