What is Right-of-Way?

Right of Way (R/W) is land dedicated or purchased for the use and benefit of the public and is used for transportation and utilities. Within the R/W are streets, shoulders, sidewalks, alleys, paths, and bridges. Additionally, there are underground, at grade, and overhead public and private utilities. The R/W is owned by the public; in Scottsdale, the Transportation Department is the steward of the R/W.

The following are examples of activities that occur in the R/W:
Transportation, including:

  • Private vehicles
  • Commercial vehicles
  • Transit
  • Bikes
  • Pedestrians
  • Capitol improvements
  • Developer improvements
  • Maintenance and installation of utilities
  • Maintenance of the transportation infrastructure
  • Special Events

Right-of-Way Management
Why do we need a Right of Way Management Program?

The primary purpose of the Right of Way Management Program (RWMP) is to establish policies and procedures to effectively and efficiently manage and coordinate activities that occur within the public R/W, in a way that enhances safety, coordinates uses, and preserves mobility.

The RWMP will establish and cultivate a central point of management that will be responsible for coordination of the often competing activities. This central clearing house will review and schedule activities to avoid conflicts, and will attempt to coordinate and consolidate activities that are scheduled to occur in the same vicinity to avoid multiple lane closures and restrictions. The program will establish fines and sanctions for non-compliance.


Components of the RWMP
What does it consist of?

City of Scottsdale RWMP brings together elements from several documents and publications into one single, easy to understand program, which includes:

  • Part 6 of the MUTCD, published by the FHWA.
  • The Phoenix Barricade Manual (latest edition)
  • Section 5-2 of the City of Scottsdale Design Standards and Policies Manual (DS&PM)
  • City Code and Ordinance

How does it work?

Requests to temporarily occupy the R/W (in the form of an encroachment permit) are reviewed and approved by RWMP staff. A violation of the program in the form of unauthorized closures or restrictions could result in fines or sanctions against the contractor or barricade company

What will the RWMP do for me?

For Transportation System users:

    • Improve motorist and pedestrian safety within construction zones
    • Reduce congestion and traveler delay
    • Coordinate road restrictions and events
    • Increase communication and awareness
    • Elimination of unexpected restrictions

For Contractors, Utility Companies, Event Organizers:

    • Enhance worker and event participant safety
    • Improve coordination with surrounding projects
    • Provide safe, orderly flow of traffic through zones
