| According to statistics, motor vehicle crashes are the leading cause of death and serious physical injury for children under five years of age. Approximately 15 to 20 children in that age range die each year in Arizona as a result of mis-usage or non-usage of child safety seats. |
For these reasons, the Scottsdale City Court, in cooperation with the Scottsdale Police Department has instituted the Children are Priceless Passengers (C.A.P.P.) program. The program is a pilot child safety seat program set up to address citations with a violation of A.R.S. 28-907A . |
If a defendant is charges with A.R.S. 28-907A , there are three options for resolving that charge: |
- Plead “not responsible” and set it to Civil Traffic Hearing.
- Plead “responsible” and pay the $118 sanction.
- Participate in the C.A.P.P. program.

| If a defendant requests an extension for the program, they MUST return to the Court on or before their new arraignment date to provide proof of compliance. |
| Any defendant charged with “No Child Passenger Restraint” will be given an information insert describing the C.A.P.P. Program with the bond card. The fee for the class is $25 (cash or money order only), and is available in English and Spanish. |

How To Participate |
| The defendant must call one of the above locations to register for a class. |
- Daycare is not provided and children are not permitted at the classes.
- The defendant must bring their child safety seat to the class for an inspection and check for recall. If the defendant does not own a safety seat, he/she will have an opportunity to obtain a new child safety seat during the class.

| Upon completion of the class, the student will receive a certificate and must present it to the Court on or before their arraignment date. Once compliance is shown, the fine will be suspended. |
| If a defendant fails to appear for the arraignment and show proof of compliance, a default judgment will be entered. |
