How Do I Claim My Vehicle?

Before requesting a hearing, please determine if you even need a hearing by reviewing the three types of releases.  if you know you need a hearing, and you know you qualify to have one, you may request a hearing at this link.  Request a Hearing. 

There are three types of release, which are discussed below:

1. If your vehicle was towed for ARS 28-872, you do not need to contact the police department unless you wish to challenge the reason your vehicle was towed. You may request a hearing, but it is not necessary to have a hearing in this instance in order to claim your vehicle. You do not need a vehicle release form from the police department.  You may claim your vehicle at any time by contacting the towing company.

The remaining releases, STANDARD and EARLY pertain to your vehicle if it was towed for ARS 28-3511


2.  STANDARD RELEASE
(for vehicles towed for ARS 28-3511, 30 day impoundment)

To retrieve your vehicle on or after the required 30-day impoundment, you must bring your valid driver license and proof of current registration to the Scottsdale Police Department at 9065 E. Via Linda.  The towing company is prohibited from releasing to you unless you have the SPD release form. 

    • Please resolve all driver license issues with the court and/or Motor Vehicle Division. 
    • Your vehicle cannot be released (ARS 28-3512.F) unless your driver license and registration is valid.   
    • If you recently purchased this vehicle but have not transferred the title into your name, you must do so before claiming it.  
    • You must show proof of current financial responsibility; in compliance with the financial responsibility requirements of chapter 9, article 4 of this title. (Proof of current insurance, unless presenting proof that the vehicle has a valid salvage or dismantle certificate of title.)
    • If you are required to have an interlock device on your vehicle, you must provide proof of installation.
    • Upon verification of these items, Scottsdale Police Department will give you a release form to claim your vehicle. 
    • Presentation of fraudulent documents is a crime. All documents will be verified   

If you meet these requirements you will be given a release form from the Police Department and you must take this release form to the towing company. 

The towing company is prohibited from releasing this vehicle to you unless you have the SPD release form. 

You must pay all towing and storage fees and you must show the towing company photo identification and proof of ownership in order for this vehicle to be released to you.

Please note: If this vehicle is unclaimed for more than ten (10) days after it is eligible for release, under Arizona law the towing company may file a claim for an abandoned title and seek ownership of this vehicle.

3.  EARLY RELEASE

You may be eligible to retrieve your vehicle before the end of the 30-day impound period.

If you meet any of the conditions below, you must request a hearing within 10 days from the date of impound in order for it to be considered for release. The hearing officer may determine your vehicle is eligible for immediate release. The vehicle will not be released early without a hearing. Only the vehicle owner or lien holder on the registration & title at the time of the impoundment, or the owner’s spouse or an attorney representing these persons, may request a hearing. Hearings are held within five working days of receipt of the request and will generally be held telephonically.

During the hearing, the hearing officer will consider the following evidence or circumstances in determining if the vehicle can be released prior to the 30th day.  Any of these circumstances may make the vehicle eligible for early release:

    • It had been stolen prior to being impounded (a police report is required);
         
    • It was driven by an employee of a business (including a parking service or repair garage) and the employer's vehicle is subject to bailment (leased vehicle);
         
    • The owner's driver license has been reinstated;
         
    • It is a rental vehicle (and it was not being driven by an employee or owner of the rental vehicle company at the time of impoundment);
         
    • The owner or owner's spouse (NOT the person driving the vehicle at the time of impoundment) will agree to enter into an agreement with SPD at the time of the hearing. The agreement will be for one year you will be certifying you will not allow this vehicle to be operated in violation of ARS 28-3511 or it will not be eligible for early release for future violations of ARS 28-3511;
         
    • Before release, the court has ordered it to be equipped with a certified ignition interlock device and proof of installation is shown to the hearing officer;
         
    • You or your company wish to reposses the vehicle. (Lienholder and repossession information);   
        
    • During the hearing, it is determined by the hearing officer that the vehicle was improperly impounded by the officer.

At the conclusion of the hearing, you will be notified if this vehicle is eligible for immediate release (a copy of the hearing decision will be mailed or handed to you). If your request is denied, you must wait until the 30-day impound period has expired and follow the instructions above (see STANDARD RELEASE). If your request is approved, you may retrieve your vehicle by bringing your valid driver license with photo (matching photo identification), valid registration, proof of financial responsibility (current insurance card) and any documents relating to the fact that you satisfied any court or motor vehicle actions/suspensions/revocations/cancellations OR proof of vehicle interlock installation if required to the Scottsdale Police Department at 9065 E. Via Linda

Please note:
Except for stolen vehicles or improperly impounded vehicles, the vehicle owner is responsible for all fees relating to the impoundment, including vehicles eligible for early release.
